REASON FOR REFERRAL:
AAAAAAA LLLLLL was
seen for a complete psychiatric and psychological evaluation to
assess and determine his current cognitive, neuropsychological,
emotional, and personality functioning. Furthermore, this
evaluation also consisted of determining his overall
psychological functioning and mental state prior to and during the
unfortunate event that occurred on May 5, 1986.
AAAAAAA was evaluated
on May 15, 1986 by Doctor , on January 17 and 18, 1988 by Doctor
Pierre Laboulangerie, and on February 7 and 8, 1988 by Doctors
Jean Lacharcuterie and Pierre Laboulangerie. The patient was
incarcerated on May 7th of 1986 after being involved
in the kidnapping and homicide of his 12-year-old cousin, DDDDDD
CCCCC. It should be noted that after his initial evaluation, Doctor
continued to see on a weekly basis for individual psychotherapy
and to monitor his mental and emotional status.
HISTORY OF PRESENT ILLNESS:
The events that
occurred from December of 1985 until the period of incarceration will
be presented in detail given the fact that they pertain directly
to the mental and emotional status of this patient.
H.I. was functioning in
a normal fashion until the end of December, 1985. At that time he
became tangentially, but as it turned out, destructively involved with
the husband of the Somali Embassador to Nigeria, Mr. N.Y. Within
the context of being terrorized and witnessing, experiencing, and
being subjected to a multitude of extremely traumatic events,
H.I. suffered severe psychological trauma.
H.I. reported that the
first of this sequence of events occurred on December 30, 1985
when he was 18 years old. During a party at the Cultural House of the
Somali Embassy, which was organized by H.I., a schoolmate, and
GGGGGG , who was the youngest son of Mr. ? and H.I.'s former high
school classmate, the patient witnessed Mr. , "a large,
corpulent, muscular man with big rings on his fingers," anally raping a
young man "in his late teens or early 20's." He stated that he
kept it secret in order to obtain the "trust and confidence" of
this powerful man, and to "have leverage on him."
During the end of
January and the beginning of February of 1986, H.I. engaged in
what seemed to be "fantasy conversations" with GGGGGG Wilson.
During this time, the patient expressed his willingness to
participate in criminal activities with his friend's family. The
patient stated that he had observed that "they were very wealthy, drove
nice cars, had a huge home, and seemed to have a lot of money,
and I became greedy." During the first or second week of March,
H.I. agreed to accompany Mr. ? , his eldest son, and an unknown
man wearing a "military uniform" to transport what he was told to be
cocaine during an alleged drug trafficking operation, during
which his involvement was limited to that of a fearful and
inactive fellow traveler. He was promised sixty thousand pesos,
or approximately four thousand dollars for being an observant.
During that same week, he was invited to go to Mr. ?'s country
home for target practice. When he arrived with GGGGGG , the
patient witnessed an argument between Mr. ? and a young man. The
latter was arguing with Mr. ? and told him, "You don't want your son to
know that you are a queer." At that point, Mr. ? took out a gun
and shot the young man. The patient stated that he went into a
state of "shock" and disbelief, and began functioning in
"robotic" manner. He stated that he felt "numb" and "could not feel."
H.I. was then ordered to assist in placing the body in the trunk
of GGGGGG's car and transporting it to a freezer at the Cultural
House of the Somali Embassy. The patient recalled feeling "crazy"
because "everyone was acting so normally in such an abnormal
situation." Later during the same week, the patient was summoned
by Mr. ? to a motel to collect the money for his involvement in
the cocaine incident, which was for accompanying these
individuals since he had no experience in these matters. When he
arrived at the motel, he found Mr. ? and an unknown man. Mr. then
took out his gun, pointed it to head, and forced him to take off
his pants to rape him anally. The patient recalls that he struggled,
and Mr. told him to get on his knees and perform fellatio on him,
as the other man videotaped the event. H.I. recalls feeling
horrified, physically sick, and nauseous, and was sure that he
was going to die. After this event, Mr. ? and his son harassed
H.I. with numerous phone calls and unexpected visits from GGGGGG
"for no apparent reason."
During this critical
period in March, H.I.'s parents were out of the country at a
broker's convention in Lesotho. Upon their return to Nigeria, his
parents were dedicated to his sister's participation in the
National Spelling Contest. Therefore, H.I. lacked the usual
attention and support from his parents because they were either away
from their home, and focused on the child that appeared to
require their concentrated dedication at the time.
From the time of
witnessing the murder, but particularly after the sexual assault,
H.I. experienced uncontrollable and profound feelings of terror,
accompanied by flashbacks and nightmares of the sexual abuse and
murder. H.I. admitted to wanting to kill Mr. ? but was very
afraid of him and his "powers." The patient then began to
contemplate suicidal thoughts, and it was during this period of
time that he began to experience the abrupt onset of initial and
terminal insomnia, frequent awakening during the night in a cold
sweat, palpitations, racing thoughts, lethargy, anhedonia, hypomania,
fluctuations in mood, hypervigilance, and ideas of reference. His
mental and emotional state was characterized by withdrawal from
others, obsessive and intrusive thoughts that "others could read
my mind and know what I was thinking, particularly ." After his
incarceration, he saw Mr. on television and felt " his evil eyes as if
he was looking at me and saying I'm going to get you." The
patient's break from reality was also precipitated by numerous
threats that he and his family would be killed if he did not follow
orders in an exact fashion. The patient also began to experience
delusions of grandeur in which he felt invincible and incredibly
powerful. However, it should be noted that he continued to
experience the aforementioned symptoms at the same time that he was
undergoing the delusions of grandeur. The patient's state of
terror, constant acute anxiety, agitation, and psychotic episode
were coupled with beliefs that he could not break the "contract" that
he had with this organization or he and his family would be
killed, and that he had to follow orders as instructed.
The week following the
sexual assault, H.I. arranged to meet a girl at the Rockomania
discotheque. He asked a friend to accompany him, and the friend
informed H.I. that GGGGGG also wanted to go. Although the patient
wanted to disengage from this family and have nothing to do with
them, he was afraid to say no. In fact, the patient had reached a
point where he felt that he was unable to refuse any requests of the P
family. At the disco, GGGGGG became intoxicated and informed him
that he was going outside to fight. H.I. saw that GGGGGG was
pushed to the ground and, in the confusion, he kicked GGGGGG in
the mouth, which resulted in 17 stitches and the loss of two of his
teeth. The patient reported that he was going to help GGGGGG
while the latter was on the ground. However, as he approached
him, he felt a wave of uncontrollable rage and did not realize
that he was lifting his foot to kick GGGGGG. He recalled that he had
images of Mr. ? forcing him sexually and experienced vivid images
of the gun, the man's penis, and the actual act of fellatio.
These images were intruding into H.I.'s mind as he was hurting
GGGGGG. After the incident, Mr. ? pursued the young man who was
supposed to have fought with his son, and threatened him with a
gun in broad daylight on a university campus. Mr. then visited
H.I. at his father's office and told him that he was a "queer who
did not know how to suck." H.I. began to believe that Mr. knew he had
been the aggressor, which exacerbated his paranoia that he could
"read my thoughts even though he is not present."
During this same month,
while the harassment continued, H.I. felt worthless, his self-esteem
was very low, and he began to doubt his sexual orientation, which is
not an uncommon experience for individuals who have been sexually
abused. His symptoms persisted and in April, the patient went to
Niamey to be with prostitutes and to "prove"
his manhood. During the last week of April, the patient was approached
by GGGGGG and told that his father had a "deal for him." H.I. was
asked to deliver his cousin, DDDDDD EEEEEE CCCCC to Mr. FFFFFF.
The patient refused. After being told that Mr. FFFFFF would be
notified, H.I. felt that he could not refuse - he was unable to say
no to anything that Mr. FFFFFF requested. Two days before the
event, the patient reported the following:
"GGGGGG came to my
home. We talked in his car. He gave me a box. I hadn't agreed to
anything. The box had 3 pages of instructions, a beeper, and a
walkie-talkie. The instructions stated that I was completely
responsible if anything went wrong. I knew I had no way out. I did not
think I could refuse. I was terrified at the time. My thoughts were
jumping around from one thing to another and I couldn't control them. I
felt that I was out of control. He did not offer me money. There was no
deal, it was an order. At that point I did not care about money, power,
or myself. I did not think that anything would go wrong and that my
cousin would be hurt. At no time did I think he would get hurt. It was
not a rational thing. I went to his house and everyone saw me leaving
with him. All I could think was why is this happening to me. Nothing
will go wrong. I was told that I would be responsible if anything went
wrong, but I knew that he wouldn't get hurt. I never thought that they
would order me to do it. I never thought that they would order me to
kill him. I was very afraid that they would kill me and my family, as
they had threatened to do so."
On May 5th
of 1986, H.I. went to his cousin's house and left with him. He had
been instructed to pick up a former classmate by the name of
XXXXX, and go to an area close to Mr. FFFFFF' country home, tie
up the boy, and call Mr. FFFFFF. The boy was tied and placed in
the trunk of the car and Mr. FFFFFF was called. The latter instructed
H.I. to meet him in a place by a road to deliver the child, and
if he received the code of 666 on the beeper, he was to kill the
boy. The following is the patient's recount of the events. The patient
was carefully queried about his thoughts and feelings during the entire
ordeal. It should be noted that this was extremely difficult for
the patient to discuss, and he displayed intense anguish during this
recount, as well as when he was carefully questioned about being
sexually abused. This recount was not narrated as described, but
was a product of responses to numerous questions as we conducted an
inquiry of the patient's mental state before, during, and after
the homicide.
"We were in the car on
the way to the designated place where we were to meet Peter
FFFFFF. Then it happened. The beeper went off with the code 666.
At that point I was not thinking. I was very confused, scared,
nervous. We went to the back of the car and opened the trunk. I
kept getting three images in my mind. Just like when I kicked
GGGGGG. I felt a force that pushed me from behind. I kept seeing
over and over and over when FFFFFF abused me. I saw when he put
the gun on my head and forced me to..... I couldn't say no to him.
I can't say no to him. I saw when he went to the office and said
you are a little queer who doesn't know how to
suck. I kept seeing him when we had just driven by his country
home and he was standing there. I felt so scared. I couldn't say
no. I felt a force beyond my control. The images kept coming over and
over and over. I.... I.... I.... I went blank. I did not feel
anything. I did not know how to kill him. I cut him in the back.
John then held him and told me, cut his throat and I'll kill the
next one. I kept feeling this force behind me, like a wall that
would push me. My mind was jumping from one idea to another and I
couldn't stop them. It's something that comes and goes. I would
think this is wrong, and then the images would come back. FFFFFF
forced me in the images. Ever since he abused me I wanted to kill
FFFFFF. But I couldn't, I can't. I fear him. I can see his face,
even now if I look at that wall. I see a picture of him right
there on the wall. I felt so much rage. For a time I thought I was
doing something to ??? . I couldn't stop the
knife, I couldn't, I couldn't.... Sometimes I wake up and I feel like
FFFFFF is here. I have to make sure that he isn't. I felt so much
rage when I kicked GGGGGG and then when I was with the knife
hurting my cousin. Each time I picked up the knife, I saw the images. I
didn't know who I was killing. I did not know who I was or that the boy
was my cousin. After I was here one or two weeks I saw FFFFFF on
television. He was looking at the reporters the same way he looked at
me and when I went to his country house. On television he had a
penetrating look and was saying to me I'm going to get you. I
knew that he was saying that with his eyes."
After the event, the
patient continued in an agitated, hypomanic, and psychotic state,
and with the delusion that he was invincible and omnipotent.
During his incarceration, he has continued experiencing symptoms
of a post-traumatic stress disorder, characterized by flashbacks
of the violent episodes, and of Mr. FFFFFF' face and penis. In
addition, he is also experiencing nightmares, frequent awakening
during the night, acute anxiety and agitation, initial insomnia,
and ideas of reference that Mr. FFFFFF can "read my thoughts and
I can still see his face and feel his presence."
PAST MEDICAL HISTORY:
Information regarding
the patient's medical history was obtained from CCCCCCCCC and
from an interview with his parents. According to these sources, the
patient's past and present medical history is unremarkable. There
is no history of major medical illnesses, hospitalizations, head
injury, loss of consciousness, epileptic seizures and/or
convulsions, or metabolic disorders. There is also no history of
alcohol abuse or any use or abuse of illegal substances.
PAST PSYCHIATRIC HISTORY:
According to the
above-mentioned sources, there is no history of psychiatric illness in
the patient's life or in any of his family members. There is no
history of a conduct disorder or any prior legal involvement.
PSYCHOSOCIAL HISTORY:
Historical information
was obtained from interviews with the patient, the patient's
family, academic records, and from studying documents pertaining
to the case.
Psychosocial history
reveals that CCCCCCCCC AAAAAAA LLLLLL was born in Lagos, Nigeria
at St. James' Maternity Hospital. His birth and developmental
milestones were within normal limits, and there is no history of
significant medical, psychological or psychiatric problems
throughout his childhood and adolescence. A mild phase of
separation anxiety was reported with the onset of pre-kindergarten
until the age of seven. The patient attended elementary and high school
at St. Luke's school for boys. Reportedly, he had friends and
experienced no difficulties in the socialization process. His
grades, academic performance, and conduct were within normal limits.
Examination of his school grades since 1992, and review of his
academic college transcripts revealed average to above-average
grades, and no evidence of conduct difficulties or any behavioral
disturbances that could be considered abnormal or problematic. There is
no history of a conduct disorder or significant violations of
norms during his developmental years. He appeared to develop
well, and completed the appropriate tasks within the expected
time limits. There is no history of sexual and/or physical abuse
in this young man's childhood. Since the eighth grade, the patient
worked in various jobs commensurate with his age, e.g., packaging
in a supermarket, etc.
After graduating from St.
James', the patient attended college at the Lagos State
University, and completed three semesters in Business Administration
until the time of his arrest. The patient is currently enrolled
at Niamey Lutheran University and has completed his sixth
correspondence course during his year-and-a-half period of
incarceration.
The patient has an
18-year-old sister, YYYYYY RRRRRR AAAAAAA ZZZZZZ, who is
currently attending the City University of New York in New York City.
She is described as being an outstanding student, and has
received multiple academic awards. CCCCCCCCC reported an excellent
relationship with her. The patient's father, AAAAAAA, is a successful
and highly respected businessman in the insurance field in
Nigeria. His mother, AAAAAAA, raised CCCCCCCCC and his sister ZZZZZZZ
until they were 12 and 10 years old, respectively. She then went
to work with her husband, who opened his own insurance business.
CCCCCCCCC's parents' marriage has been very stable, and the
family is well-known, respected, and appreciated in the community.
The reaction and
subsequent behavior of CCCCCCCCC's family has been noteworthy.
Their initial reaction was of profound shock, disbelief, and sadness.
Not only had they lost a beloved nephew of whom they were
extremely fond and cared about very deeply, but when they learned
that their son had been responsible they were devastated and
shattered. Since CCCCCCCCC's arrest, his family has not abandoned him.
On the contrary, they have been extremely involved in his
rehabilitation, as evidenced by their visits to him on every
visiting day, providing him 100 books pertaining to the salvation
of his soul and mind, arranging psychiatric treatment by a highly
respected and well-known local psychiatrist, Dr. William
RRRRRRRRRRRRR, arranging visits by Father X for spiritual
guidance, multiple visits from Niamey by CCCCCCCCC's relatives,
especially Doctors AAAAAAA and PPPPPP, who are the boy's uncles,
and by offering constant support in a physical and emotional
manner.
MENTAL STATUS
EXAMINATION:
The patient was initially
examined on May 15, 1986. He was alert and oriented in three
spheres. Although CCCCCCCCC denied positive psychotic signs, he
exhibited an intense degree of anxiety, guardedness and
suspiciousness. Upon initial approach, it was difficult for
CCCCCCCCC to sustain eye contact, and he seemed aloof, distant, and
overwhelmed by internal processes, bewildered, and extremely
terrified to the extent of seeming disconnected from the
environment and others. His level of distrust and sense of
imminent threat had reached paranoid and delusional proportions.
He exhibited marked constriction of affect and emotional
withdrawal.
Examination of the
patient on January 17 and 18, 1988 revealed that CCCCCCCCC
AAAAAAA LLLLLL is a 20-year-old, black, Nigerian male who appears
his chronological age. He was interviewed for a total of 12
hours, which included the administration of a full battery of
psychological tests (Tests administered and test findings to
follow). The patient was seen in his cell at St. Paul's Correctional
Institute in Niamey. His cell is quite small and was previously a
bathroom that was converted into "living quarters" in order to
ensure an isolated and restricted environment for the
patient's safety. He has been confined since May 5, 1986. On the walls,
there are numerous family pictures, sheets of paper with
geometric figures and mathematical equations to prepare for
tests, a map of the Roman Empire, a newspaper clipping honoring his
paternal grandfather after the latter's demise, a copy of
Rembrandt's "Prodigal Son," given to him by his father, and
numerous textbooks, including a Bible, a dictionary, and various
academic books pertaining to his education.
CCCCCCCCC is
approximately 5 feet 10 inches tall, and of average build, although
he underestimated his height by 2-3 inches. He was dressed in
long shorts, a T-shirt, and tennis shoes. His manner and behavior
was open, pleasant, attentive, and fully cooperative throughout
the entire examination and over the course of both lengthy
evaluation sessions. Although visibly and appropriately tired toward
the end of the first day, he remained alert, cooperative, and
diligent in all of the tasks that were required of him. His
speech was intermittently loud and pressured, thus revealing a
persistent anxious state. Movements of his hands and occasional
restlessness were also evident and congruent with anxiety. His
speech was coherent, spontaneous, and normal in production and
delivery, although on one occasion, when describing the murder of the
young man by Mr. FFFFFF, the patient became visibly distant,
confused, non-coherent, and his verbalizations became very
difficult to follow. This episode lasted several minutes, and was
followed by a period of circumstantiality in his thinking process,
which required redirection. He was able, after several minutes,
to regroup and continue with that portion of the examination.
When asked a question, CCCCCCCCC became pensive and then
responded with an open and genuine attitude. At no time did he blame
others or externalize the nature of his actions. He did, however,
describe his state of mind as confused, numb, and disconnected
from his movements and actions. This was also observed during the
clinical interview.
From a cognitive
perspective, the patient was fully alert and oriented in the three
dimensions. On the Folstein Mini-Mental Status Examination, a global
measure of cognitive functioning, he obtained a score of 29/30,
only unable to recall the date, which is not uncommon among
hospitalized and incarcerated individuals. His immediate, recent,
and remote memory functions were intact, he was able to follow
simple psychomotor commands, and there were no signs of aphasia,
agnosia, apraxia, or anomia. His language functions were intact,
except when flooded with painful affect. Although he was
able to perform correctly on simple arithmetic problems, he did
display mild to moderate concentration difficulties on this task.
He seemed very unsure of his responses and verbally calculated
and re-calculated in a rather obsessive fashion prior to offering
a response. During this task he stated, "This produces a lot of
anxiety. I feel anxious and I put a lot of pressure on myself. I
don't trust my mind on these calculations." Consequently, his
responses, although accurate, were quite delayed and with long
pauses prior to responding. Overall, and based on superficial
observation, his thought processes appeared intact with no
evidence of a formal thought disorder, i.e., loose associations,
flight of ideas, blocking, or neologisms. As noted, there were
glimpses, however, of a thought process disturbance, as evidenced
by confusion, incoherence, and circumstantiality. Evidence of the
presence of a psychotic process will be elucidated in the Test
Results section and based on projective test findings. The patient's
thought content was primarily flexible, as he was able to shift
from topic to topic. However, his thoughts appeared ruminative
and moderately delusional as he described the "presence" of Mr.
FFFFFF, and his ability to "know what I'm thinking." The flashback
image of "evil eyes and face" were paranoid and delusional in
nature, giving evidence to the presence of ideas of reference.
Although CCCCCCCCC strongly considered suicide after being
sexually molested, he denied suicidal ideation, intent, or plan at this
time. After careful consideration of the events, the sexual abuse
and resulting suicidality appeared to contribute to his psychotic
break and delusional thinking. The patient also denies homicidal
thoughts, wishes, intent, or plan. At this time, there is no evidence
of a perceptual disturbance in the form of auditory, visual,
tactile, olfactory, or gustatory hallucinations. His reality
testing impairment appears to be confined to delusional thinking.
CCCCCCCCC's affect
appeared constricted, with a limited range in affective expression.
Nevertheless, it was appropriate to content and consistent with the
topic at hand. For instance, when describing the most difficult
incidents, e.g., the sexual abuse, the young man's violent death,
and particularly the homicidal episode, his anguish became very
visible in his facial expression; he placed his hands on his face;
rested his elbows on his knees; stared at the floor; his face and
neck became flushed and turned bright red; and he repeatedly
verbalized, "Forgive me Lord." His mood denoted an overall dysphoria,
with fluctuations between anxiety and sadness. During moments of
profound sadness, his facial expression became forlorn and his
speech was barely audible and monotonic. Gross examination of his
judgment revealed the ability to distinguish right from wrong, and
a strong, archaic, punitive superego (conscience) which appeared
to be unrelenting and self-directed. He appeared to have adequate
insight into the nature of his actions and his current
psychological disturbance. That is, he seemed to understand the fact
that he requires psychiatric treatment due to the nature of the
traumas and incidents that have taken place in his life. Paranoid
thinking and intrusive flashbacks, however, appear at times, to
impair his ability to distinguish reality from fantasy.

TEST RESULTS:
Cognitive and Intellectual
Functioning:
As noted, gross cognitive
examination on the Folstein Mini-Mental Status Examination
yielded results that were within normal limits. CCCCCCCCC's Full Scale
Intelligence Quotient (IQ) of 99 falls at the 47th
percentile in comparison with others of his age, and places him
in the Average classification. This IQ provides an assessment of
general intelligence and of general occupational and scholastic
aptitude. These results, however, underestimate his actual
intellectual potential, and appear to have been affected by the
patient's level of anxiety and post-traumatic emotional sequelae, which
interfered with his ability to concentrate and mentally manipulate
information. This cognitive decline is obtained by comparing his
Vocabulary subtest scaled score of 14 ( 95th Percentile ),
the single most sensitive measure of premorbid functioning on the
WAIS-R, with his attention-concentration mean score of 8.6, which
is a highly statistically significant difference and suggests
cognitive deterioration. Furthermore, comparison of the verbal
mean with the attention-concentration factor ( 12.6 and 8.6,
respectively ) also revealed a statistically significant
difference between the two scores, suggesting impaired
concentration and overall cognitive impairment secondary to trauma.
CCCCCCCCC obtained a
Verbal IQ of 103, which falls at the 58th percentile. This
IQ provides an indication of his verbal abilities, information,
and the ability to reason with words. However, four of the
subtest scores differed significantly from his average verbal
score. Therefore, this patient's Verbal IQ is an average of
inconsistent performance, and may need to be so interpreted.
The patient's Performance
IQ of 95 falls at the 34th percentile. This IQ contributes
an understanding of his perceptual organization, the ability to
employ visual images in thinking and to process visual material
efficiently. None of the scores contributing to the Performance
IQ differed significantly from CCCCCCCCC's average performance score.
Therefore, the Performance IQ appears to be a good summary of
his abilities in this area.
The relatively low scores
on the Digit Span and Arithmetic subtests may be associated with
distractibility, short attention or memory span, and poor concentration
in comparison with other individuals of CCCCCCCCC's age and
ability. These subtests are also very sensitive to emotional
states and effects of trauma. The low scores on Similarities and
Picture Completion, relative to his other scores, may be associated
with a tendency toward concrete or other unusual thought
patterns, a finding that is consistent with the results on
projective tests and suggest the possibility of a thought disorder.
The patient's
Comprehension score is significantly higher than his average verbal
subtest score. This suggests relatively above-average ability to
size up practical or social situations that require common-sense
reasoning. Such scores imply the effective use of one's
knowledge. Under severe stress, however, impairments in judgment and in
the ability to reason may occur even though he has the capacity
for adequate judgment and reasoning under normal conditions.
Comparison of subtest
means revealed a significant difference in favor of verbal skills
versus perceptual-analytic cognitive abilities, rendering this patient
cognitively field-dependent. This cognitive style suggests personality
tendencies such as susceptibility to dependence on other people
for guidance and direction, and a tendency to need external
structure and support. It should be noted that impulsivity and
acting-out tendencies are inconsistent with this cognitive style.
Neuropsychological Functioning:
A neuropsychological
screening test battery was administered, which yielded results
within the normal range. CCCCCCCCC obtained an impairment index of
1.30, which is lower than the 1.55 cutoff score for suspected
organic impairment. On the Aphasia Screening Test of the
Halstead-Reitan Neuropsychological test battery, he obtained no
errors or any evidence of construction apraxia, anomia, spelling
apraxia, agraphia, letter and number agnosia and alexia, central
dysarthria, auditory verbal agnosia, acalculia, ideo-kinetic
apraxia, right-left disorientation, body agnosia, and/or visual,
auditory, and tactile suppression.
On the trails A, however,
the patient displayed mild visual-motoric speed impairment, which
appeared to be a function of anxiety given that this was the first
timed test of the battery, and his performance on the Digit
Symbol and Trails B was within normal limits. His performance on the
Trails B, the single-most sensitive instrument for the
identification of organic impairment, was within normal limits. That
is, he was able to appropriately shift cognitive sets and follow
a more complex mental sequence. In summary, these results are
consistent with the absence of organic impairment and provide no
evidence for a neuropsychological dysfunction or compromise.
Emotional and Personality
Functioning:
Results of objective and
projective tests reveal the presence of psychopathology that is
consistent with individuals who have experienced severe psychological
trauma, namely, a severe affective disturbance and depressive
condition, a reality testing impairment, limited and traumatized
ego functions and weakness, impoverished self-worth and
self-esteem, and phobic remnants of systematic abuse.
Results of the Minnesota
Multiphasic Personality Inventory - 2 yielded valid findings
based on the elevations of the validity scales. That is, this patient
answered in a truthful manner, and with no evidence of either
over reporting or under reporting psychopathology. There were
elevations on two of the clinical scales that pertain to
admission to antisocial acts, distrust for individuals in positions of
authority, and paranoid features. The elevation on the paranoid
clinical scale is consistent with the manifestation of psychotic
behavior, the presence of a thought disorder, ideas of reference, and
delusions of persecution. CCCCCCCCC also obtained a very low
score on the mania scale, suggesting depression, lethargy,
listlessness, and overall apathy. Furthermore, he obtained an
abnormally low score on the ego strength supplementary scale, which
is consistent with limited personal resources for coping with
problems and stressors, and with low self-esteem. There is also
evidence for being overwhelmed with affect, and having difficulty
processing and expressing feelings in an outwardly fashion. There is
also the presence of anger and aggression, which is not an
uncommon finding among those who have been abused, manipulated,
and exploited. It should be noted that CCCCCCCCC's profile is
inconsistent with the typical profiles of antisocial personality
disorders, and with individuals who have been incarcerated for
premeditated homicide and/or sexual misconduct and offenses.
CCCCCCCCC was
administered the Clinician Administered Post-Traumatic Stress
Disorder Scale for DSM IV (CAPS-Dx). The CAPS-Dx is a structured
interview with demonstrated psychometric properties, i.e.,
reliability and validity, and has achieved excellent diagnostic
utility.
Results of the CAPS-Dx
revealed that following the sexual assault he suffered in March,
1986 CCCCCCCCC experienced symptoms which met the diagnostic criteria
for Post-Traumatic Stress Disorder, Chronic. These symptoms included:
intrusive, highly distressing thoughts, images, and memories of
the event; flashback episodes or reliving the experience; intense
feelings of restlessness, nausea, vulnerability, anxiety, terror and
rage in response to memories of the event; persistent avoidance
of stimuli (people, places, activities, thoughts, and feelings)
associated with the event; detachment or estrangement from other
people (especially his family); and symptoms of hyperarousal, including
racing thoughts, sleep difficulties, irritability, volatility,
sensitivity to noise, and difficulty concentrating. Finally
CCCCCCCCC experienced clinically significant distress and
impairment in his functioning.
On the Beck Anxiety
Inventory, the patient admits to moderate symptoms of
psychological anxiety, but denies any of the physiological
manifestations, which is inconsistent with clinical observations
and the symptoms that he is currently experiencing, namely,
flashbacks, insomnia, nightmares, and perceptual disturbances.
Similarly, he obtained a depression score in the mild range of
depressive disorders and failed to endorse items on the MMPI-2
that pertained to depression. This, however, is consistent with the
fact that he appears to be disconnected from his affective state
and is unable to recognize his current affective disturbance,
particularly due to the fact that there are numerous findings on
the projective tests of a severe depression, and also due to the fact
that the MMPI-2 suggests a dysthymic disorder as one of the
possible diagnoses based on the results.
Clinical interpretations
of the Rorschach Psychodiagnostique were obtained utilizing the
Exner system and based on the statistical analysis of this protocol.
Findings on the Rorschach Psychodiagnostique reveal the presence
of a major affective disorder and a reality testing compromise
manifested by distortions of reality and the potential for a
psychotic break. The most significant finding on this portion of the
examination is the fact that CCCCCCCCC obtained an F+% of 32,
which is highly significant as to the potential for losing
contact with reality and becoming psychotic, particularly under severe
stress and/or under affect-laden conditions. That is, his score
is significantly lower than the expected F+% of 70 or higher for
perceptions to fall within the normal range in order to have the
ability to function within reality and not be prone to become
delusional and psychotic.
This protocol is also consistent with
individuals who have been severely abused due to the unequivocal
evidence of very low self-esteem; serious difficulty modulating
affect; emotions dominating the ability to think, process, and
reason in a normal fashion; the tendency to avoid emotional
stimuli and, as a result, become socially constrained or
isolated; the tendency to be more negativistic or oppositional toward
the environment than most people; confusion about feeling both
positive and negative toward the same stimulus situation;
detachment and intellectualization and a tendency to distort reality; a
distinct hypervigilant and paranoid psychological state resulting
from mistrust of the environment and feelings of vulnerability;
passivity and the tendency to surrender to others; the tendency
to perceive aggressiveness as a natural manifestation in
interpersonal relationships; problems in processing information;
flight into fantasy and denial of reality; helplessness and
vulnerability to the manipulations of others; vulnerability to
disorganization during intense emotional experiences; and serious
problems in thinking and faulty conceptualization which interfere
with logic and promote faulty judgment.
Content analysis reveals
the presence of remnants of psychological trauma, e.g., "An evil
face of someone evil. It has a diabolical expression, angry, with a
burlesque smile." Furthermore, there are numerous responses that
pertain to sadness and overall dysphoria, as evidenced by
content, shading, and amorphous shapes and colors. These findings
were consistent with his responses on the Thematic Apperception
Test, in which there are tragic endings to his stories and the
presence of a strong, punitive conscience that appears to be
unrelenting in nature. His drawings are also consistent with
impoverished self-esteem and with feelings of frailty, defenselessness
and vulnerability to the environment and the world.
FORMULATION:
CCCCCCCCC AAAAAAA is a
20-year-old young man who was involved in the kidnapping and
homicide of his 12-year-old cousin after a series of highly
traumatic incidents in which he was systematically, maliciously,
and repeatedly exposed to severe and horrific psychological
trauma. His overall psychological profile is that of an
individual who is intellectually bright and has the potential for high
intellectual functioning. However, even though he scored in the
average range of intelligence, he displayed cognitive
deterioration and was not functioning at his true intellectual
capacity. Although there are no positive organic findings
in his protocol, he displayed difficulties with
attention and concentration, and with the ability to process
information, particularly when under stress. His cognitive style
is consistent with field-dependence; this suggests a
vulnerability to manipulation by others, a psychological dependence on
others for affirmation, and a need for structure. There is ample
test evidence of the potential for psychosis and impaired reality
testing, as well as a major affective disturbance in the form of
an underlying and subclinical depression. There is also evidence of the
effects of psychological trauma - of having been psychologically
and physically abused, and rendered helpless and under the
control of a powerful other, whom he was unable to contradict or
escape. In this case, CCCCCCCCC reached a point in which his
normal psychological defenses were broken, and he was functioning
in a robotic and totally disengaged manner.
This case is
conceptualized and his behavior explained from the perspective of a
psychotic disorder, a posttraumatic stress disorder, and the
controlling influence of a powerful other from whom CCCCCCCCC
believed he could not escape. These three issues will be dealt
with separately.
According to Taber's
Cyclopaedia Medical Dictionary, a psychosis is defined as "a
term formerly applied to any mental disorder, but now generally
restricted to those disturbances of such magnitude that there is
personality disintegration and loss of contact with reality. The
disturbances are of psychogenic origin, or without clearly
defined physical cause or structural change in the brain. They
usually are characterized by delusions and hallucinations... This
condition is manifest in the behavior, emotional reaction, and
ideation of the patient. He fails to mirror reality as it is, reacts
erroneously to it, and builds up false concepts regarding it. Behavior
responses are peculiar, abnormal, inefficient, or definitely
antisocial. All this does not include amentia because defective
intelligence merely lessens comprehension of reality but does not
distort it..." Steadman's Medical Dictionary adds, "A mental
disorder causing gross distortion of a person's mental capacity,
affective response, and capacity to recognize reality,
communicate, and relate to others to the degree of demands of everyday
life..." According to the Diagnostic and Statistical Manual
of Mental Disorders (DSM IV), the term psychotic pertains to
actual symptoms such as delusions, and prominent hallucinations,
disorganized speech, or disorganized or catatonic behavior. In this
case, the most prominent psychotic symptom is that of a delusion,
which DSM IV defines as "erroneous beliefs that usually involve a
misinterpretation of perceptions or experiences." In order to
meet criteria for a Brief Psychotic Disorder, DSM IV includes delusions
as one of the symptoms that must be present in order to receive
this diagnosis. Furthermore, DSM IV states that, "individuals
with Brief Psychotic Disorder typically experience emotional
turmoil or overwhelming confusion. They may have rapid shifts from one
intense affect to another. Although brief, the level of
impairment may be severe....poor judgment, cognitive impairment,
or acting on the basis of delusions....The duration of an episode
of the disturbance is at least one day but less than one month,
with eventual full return to premorbid level of
functioning....With Marked Stressor....may be noted if the
psychotic symptoms develop shortly after and apparently in
response to one or more events that singly or together, would be
markedly stressful to almost anyone in similar circumstances in
that person's culture." In order words, a psychosis involves the
inability to function within the bounds and constraints of
reality at a given time.
In CCCCCCCCC's case,
there is evidence of rapid shifts in affect, disorganized
behavior, and actions based on the perception of a "force" that
was pushing him "from behind." He was seen by numerous people
leaving home with his cousin, and still believed that nothing
wrong would happen. It is also important to note that his reported
state of mind of the images and thoughts that were flashing in
his consciousness gives further evidence to a psychotic state.
Given that he used such faulty judgment and that he is not
intellectually deficient, the psychotic aspect of his illness
appeared to be the primary mental state of this patient prior to
and at the time of the homicide. In addition, there is clear evidence
of the potential for distortions of reality and of psychosis on
the Rorschach test in that his form level was significantly below
what is expected for normal functioning. There is also evidence
on the MMPI-2 of paranoid thinking. This fact, coupled with a reality
testing impairment leads to the conclusion of a psychotic process.
According to the DSM IV,
the diagnostic features of a posttraumatic stress disorder that
pertain to CCCCCCCCC's case are " the development of characteristic
symptoms following exposure to an extreme traumatic stressor
involving direct personal experience of an event that involves
actual or threatened death or serious injury; threat to one's
physical integrity; witnessing an event that involves death, injury, or
a threat to the physical integrity of another person..." Among
the symptoms that are outlined by the DSM IV, CCCCCCCCC met
criteria for the following: The person's response involved
intense fear, helplessness, or horror; recurrent and intrusive
recollections of the event including images, thoughts, or
perceptions; recurrent dreams of the event; acting or feeling as
if the traumatic event was recurring; intense psychological distress at
exposure to internal or external cues that symbolize or resemble
an aspect of the traumatic event; physiological reactivity on
exposure to internal or external cues that symbolize or resemble
an aspect of the traumatic event; efforts to avoid thoughts, feelings,
or conversations associated with the trauma; feelings of
detachment or estrangement from others; restricted range of
affect; difficulty falling or staying asleep; irritability or
outbursts of anger; difficulty concentrating; and hypervigilance.
According to the
scientific literature on the effects and psychological sequelae of
trauma, at the time of trauma the victim is rendered helpless by
overwhelming force. In this case, CCCCCCCCC had experienced
within one week the witnessing of the cold-blooded killing of a
young man with very little provocation, and he had been sexually raped
and forced to perform fellatio. Trauma overwhelms the ordinary
human adaptations to life. The three most common reactions to
trauma are: hyperarousal, where a permanent state of
physiological arousal is present and is the first cardinal symptom of
post-traumatic stress; intrusion, or the reliving of the event as if
recurring in the present; and constriction, in which the person
feels completely powerless and may go into a state of surrender as
the system of self-defense shuts down and he becomes
psychologically paralyzed.
The manner of
establishing control over another human being is based on the
systematic, repetitive infliction of psychological trauma,
producing a constant state of fear and terror, inconsistent and
unpredictable outbursts of violence, the intermittent use of rewards,
the destruction of normal attachments and isolation from the
family, the destruction of the victim's sense of autonomy, the
use of humiliation and shame by violating the physical body and,
most importantly, and the most destructive of all coercive techniques,
to be forced to violate one's own moral principles and to betray
basic human attachments.
The initial hollow look
in CCCCCCCCC's eyes, his detachment from his family and loved ones, the
dissociative, shallow, and psychotic initial presentation, the sense of
the perpetrator still being present, the clinical signs and symptoms
that have been noted above, as well as the scientific evidence of these
test results, point to the fact that this young man was in fact under
the psychological control of Mr. FFFFFF and was experiencing a
situation in which he felt he had no escape. Therefore this clinical
picture is consistent with a brief psychotic disorder, a post-traumatic
stress disorder, and a sub-clinical depression, No diagnosis on Axis II
will be given due to the fact that he does not meet diagnostic criteria
for any of the Axis II disorders; there is no history of a conduct
disorder or any other indicators of any major violations in this young
man's history. It is the conclusion and the consensus of this
evaluation team that CCCCCCCCC AAAAAAA LLLLLL appeared to be psychotic
at the time of the homicide and believed that he was killing Mr. FFFFFF
during the homicidal act.
Regarding prognosis and
rehabilitation, it is the consensus of this team that there is a
favorable prognosis for the following reasons:
1. BBBBB Vvvvvvv is
bright and has the intellectual capacity to understand the consequences
of
his actions and would profit from
intense psychotherapy.
2. There is evidence of
remorse and of a desire and motivation for rehabilitation.
3. It is the
understanding of this team that BBBBB Vvvvvvv has not had any
behavioral difficulties during the one-and-a-half years in which he has
been incarcerated.
4. He has a strong
support system in his family and their rehabilitative efforts.
5. He is currently able
to contain his emotions and has not lost control during his
incarceration.
6. He has the capacity
for insight.
7. He has gained greater
access to his feelings during his incarceration.
8. The patient has
demonstrated gains in his treatment with Dr. RRRRRRRRRRRRR.
9. The patient has met
with a priest on a regular basis and has profited from those
encounters.
10. There is no Axis II
diagnosis that would contraindicate the ability to profit from
treatment.

CAUSA DE REMISIÓN:
Se vio a AAAAAAA LLLLLL para una
evaluación psiquiátrica y psicológica completa a fin de evaluar y
determinar el funcionamiento actual de su personalidad
cognoscitiva, neuropsicológica y emocional. Además, esta
evaluación también consistió en determinar su funcionamiento
psicológico y estado mental generales antes del desafortunado
incidente ocurrido el 5 de mayo de 1986 y durante éste.
AAAAAAA fue evaluado el 15 de
mayo de 1986 por el doctor ???, el 17 y 18 de enero de 1988 por
el doctor Pierre Laboulangerie, y el 7 y 8 de febrero de 1988 por los
doctores Jean Lacharcuterie y Pierre Laboulangerie. El paciente
fue encarcelado el 7 de mayo de 1986 después de haber participado
en el secuestro y homicidio de DDDDDD CCCCC, su primo de 12 años
de edad. Debe destacarse que después de la evaluación inicial, el
doctor ??? continuó viendo al paciente semanalmente para darle
psicoterapia individual y supervisar el estado mental y emocional
de éste.
HISTORIA DE LA ENFERMEDAD ACTUAL:
Se presentarán en detalle los
eventos que ocurrieron desde diciembre de 1985 hasta el periodo
de encarcelamiento dado el hecho de que dichos eventos competen
directamente al estado mental y emocional de este paciente.
H.I. estuvo actuando de manera
normal hasta fines de diciembre de 1985. En ese momento se
involucró de manera tangencial, pero luego destructiva con el esposo de
la embajadora de Somalia en Nigeria, el Sr. N.Y. En un contexto
en que fue aterrorizado y presenció y experimentó una serie de
eventos sumamente traumáticos, a los cuales estuvo sometido, H.I.
sufrió un grave trauma psicológico.
H.I. informó que la primera de
esta serie de eventos ocurrió el 30 de diciembre de 1985, cuando

delictivas con la familia de su amigo. El paciente declaró que
había observado que «ésta era muy adinerada, manejaba buenos
automóviles, tenía una casa enorme, y parecía tener mucho dinero,

semana de marzo, H.I. aceptó acompañar al Sr. ?, al hijo mayor de éste,
y a un hombre desconocido que vestía «uniforme militar» para
transportar algo que, según le dijeron, era cocaína, durante una
supuesta operación de tráfico de drogas en la cual su
participación se limitaría al de un compañero de viaje temeroso e
inactivo. Le prometieron sesenta mil pesos, o sea,
aproximadamente cuatro mil dólares por mantenerse vigilante. Durante
esa misma semana, lo invitaron a ir a a la casa de campo del Sr.? para
práctica de tiro al blanco. Al llegar allí con GGGGGG, el
paciente presenció una discusión entre el Sr. y un muchacho. Este
último estaba discutiendo con el Sr.? y le dijo, «Usted no quiere que
su hijo sepa que usted es un marica». En ese instante, el Sr.?
sacó una pistola y le disparó al muchacho. El paciente declaró
que entonces entró en un estado de «conmoción» y escepticismo, y
empezó a actuar como un «robot». Declaró que se sentía «aturdido» y que
«no podía sentir nada». Entonces H.I. recibió órdenes de que
ayudara metiendo el cadáver en el baúl del automóvil de GGGGGG y
transportándolo a un congelador de la Casa Cultural de la
Embajada de Somalia. El paciente recordó que se sintió «enloquecer»
porque «todo el mundo estaba actuando de una manera tan normal en
una situación tan anormal». Después durante la misma semana, el
Sr. ? convocó al paciente a un motel para que cobrara el dinero por
su participación en el incidente de la cocaína, lo cual era por

para violarlo analmente. El paciente recuerda que forcejeó, y que el
Sr.? le dijo que se pusiera de rodillas y le practicara la
felación mientras que el otro hombre filmaba el evento con una
videocámara. H.I. recuerda haberse sentido horrorizado y nauseabundo
y estar seguro de que iba a morirse. Después de este evento, el
Sr.? y su hijo hostigaron a H.I. con numerosas llamadas
telefónicas y visitas inesperadas de GGGGGG «sin ninguna razón
obvia».
Durante este periodo crítico en
marzo, los padres de H.I. estaban fuera del país en una
convención de bolsistas en Lesotho. Al regresar a Nigeria, sus padres
se dedicaron a la participación de su hermana en el Concurso
Nacional de Ortografía . Por consiguiente, a H.I. le faltó la
atención y apoyo habituales de sus padres porque ambos estaban lejos de
la casa, y concentrados en la hija que parecía requerir en ese
momento que concentraran en ella toda su atención.
Desde el momento en que presenció
el asesinato, pero particularmente después de la agresión sexual,
H.I. experimentó sentimientos de terror profundos e incontrolables,
acompañados por escenas retrospectivas y pesadillas del abuso
sexual y asesinato. H.I. admitió que quiso matar al Sr. ?, pero
tuvo mucho miedo de él y de sus «poderes». El paciente empezó entonces
a contemplar pensamientos suicidas, y fue durante este periodo de
tiempo que él empezó a experimentar el ataque abrupto de insomnio
inicial y terminal, despertándose frecuentemente durante la noche
con un sudor frío, con palpitaciones, con pensamientos galopantes,
con letargo, anhedonia, hipomanía, fluctuaciones en el humor,
hipervigilancia, e ideas de referencia. Su estado mental y
emocional se caracterizaba por un apartarse de los demás, por
pensamientos obsesivos y intrusos de que «otros podían leer mis
pensamientos y saber de manera específica lo que yo estaba
pensando». Después de su encarcelamiento, el paciente vio al Sr.?
en la televisión y sintió sobre sí «sus ojos malvados como si él
estuviera mirándome y me dijera -voy a agarrarte». La ruptura del
paciente con la realidad también fue precipitada por numerosas
amenazas de que los matarían a él y a su familia si no cumplía las
órdenes de una manera exacta. El paciente también empezó a
experimentar delirios de grandeza en los que se sentía invencible
y increíblemente poderoso. Sin embargo, debe notarse que continuó
experimentando los síntomas mencionados anteriormente al mismo tiempo

el «contrato» con esta organización porque si lo hacía los
matarían a él y a su familia, y de que él tenía que cumplir las
órdenes tal como se le como le instruía.
La semana siguiente a la agresión
sexual, H.I. tomó las medidas necesarias para encontrarse con una
muchacha en la discoteca Rockomania. Le pidió a un amigo que lo
acompañara, y el amigo le informó a H.I que GGGGGG también quería
ir. Aunque el paciente quiso romper sus vínculos con esta familia
y no tener nada que ver con ellos, tuvo miedo de decir que no. De
hecho, el paciente había llegado a un punto en el que se sentía incapaz
de negarse a cualquier demanda de la familia P. En la discoteca,
GGGGGG se embriagó y le informó que iba a salir afuera a pelear.
H.I. vio cómo empujaban a GGGGGG al suelo y, en la confusión, él le dio
de puntapiés en la boca a GGGGGG lo que hizo que tuvieran que
darle a éste 17 puntadas y que éste perdiera dos de sus dientes.
El paciente informó que iba a ayudar a GGGGGG mientras rabia
incontrolable y no se dio cuenta de que que estaba alzando su pie para
darle de puntapiés a GGGGGG. Recordó que le vinieron a la mente
imágenes del Sr.? forzándolo sexualmente y experimentó imágenes
vívidas de la pistola, del pene del hombre, y del mismo acto de
felación. Estas imágenes se entremetían en la mente de H.I.
cuando estaba hiriendo a GGGGGG. Después del incidente, el Sr. ?
siguió al muchacho que se suponía que había peleado con su hijo,
y lo amenazó con una pistola en plena luz del día en un recinto
universitario. Entonces, el Sr. ? visitó a H.I. en la oficina de
su padre y le dijo que él era un «marica que no sabía mamar».
H.I. empezó a creer que el Sr. ? sabía que H.I. había sido el agresor,
lo cual exacerbó su paranoia de que él podía «leerme los
pensamientos aunque él no estuviera presente».
Durante ese mismo mes, mientras
continuaba el hostigamiento, H.I. sentía que no valía nada, su
autoestima era muy baja, y empezó a dudar sobre su orientación sexual,
lo cual no es una experiencia poco común en individuos que han
sido víctimas de abuso sexual. Sus síntomas persistieron, y en
abril, el paciente fue a Niamey para estar con prostitutas y
«demostrar» su masculinidad. Durante la última semana de abril,
GGGGGG se acercó al paciente y le dijo que su padre tenía un
«negocio para él». Le pidieron a H.I. que entregara a su primo,
DDDDDD EEEEEE CCCCC al Sr. FFFFFF. El paciente rehusó. Después de
que le dijeron que notificarían al Sr. FFFFFF al respecto, H.I.
sintió que no podía rehusar -él era incapaz de decir que no a
nada que le pidiera el Sr. FFFFFF. Dos días antes del incidente, el
paciente informó lo siguiente:
«GGGGGG vino a mi casa. Hablamos
en su automóvil. Él me dio una caja. Yo no había aceptado nada.
La caja tenía tres páginas de instrucciones. En las instrucciones se
decía que yo sería completamente responsable si algo saliera mal.
Yo sabía que no podía escaparme de esto. No pensé que pudiera
rehusar. En ese instante me sentí aterrorizado. Mis pensamientos
saltaban de una cosa a otra y no podía controlarlos.Sentía que estaba
fuera de control. Él no me ofreció dinero. No había negocio, era
una orden. En ese instante, no me importaba el dinero, el poder,
ni yo mismo. Yo no pensé que algo pudiera salir mal y que mi primo
fuera a resultar herido. En ningún momento pensé que mi primo iba
a resultar herido.Esto no era una cosa racional. Yo fui a su casa
y todos me vieron salir con él. Todo lo que yo podría pensar era
por qué me está sucediendo esto a mí. Nada saldrá mal. Me dijeron que
yo sería responsable si algo saliera mal, pero yo sabía que él no
resultaría herido. Yo nunca pensé que ellos me ordenarían que yo
lo hiciera. Nunca pensé que ellos me ordenarían que yo lo matara. Yo
tenía mucho miedo de que ellos nos matarían a mí y a mi familia, ya que
ellos habían amenazado que lo harían.»
El 5 de mayo de 1986, H.I. fue a
la casa de su primo y salió con él. Le habían dicho que recogiera
a un excompañero de clases de nombre XXXXX, y fuera a una área cercana
a la casa de campo del Sr. FFFFFF, atara al muchacho, y llamara
al Sr. FFFFFF. El muchacho fue atado y metido en el baúl del
automóvil y se llamó al Sr. FFFFFF. Esté último le dio instrucciones
a H.I de que se encontrara con él en un lugar junto a un camino
para que le entregara el muchacho, y si que si recibía la clave
666 en su localizador de personas, que matara al muchacho. Lo
siguiente es el recuento de los eventos por parte del paciente. Se
preguntó cuidadosamente al paciente sobre sus pensamientos y
sentimientos durante toda esa penosa experiencia. Debe notarse
que al paciente le resultaba sumamente difícil hablar de esto, y
que el paciente mostró una angustia intensa durante este
recuento, así como cuando se le interrogó cuidadosamente si
habían abusado sexualmente de él. Este recuento no se narró como
está descrito, sino que resultó de las respuestas a numerosas
preguntas, ya que nosotros realizamos una investigación sobre el
estado mental del paciente durante el homicidio, y con
anterioridad y posterioridad a éste .
«Nosotros estábamos en el
automóvil e íbamos hacia el lugar designado donde deberíamos
encontrarnos con Peter FFFFFF. Entonces ocurrió eso. El localizador de
personas sonó y marcó la clave 666. En ese instante yo no estaba
pensando. Estaba muy desconcertado, asustado, nervioso. Fuimos a
la parte de atrás del automóvil y abrimos el baúl. Yo seguía
percibiendo tres imágenes en mi mente. Igual que cuando le dí de
puntapiés a GGGGGG. Sentía una fuerza que me empujaba desde
atrás. Yo seguía viendo una vez y otra vez y otra vez más cómo
FFFFFF abusaba sexualmente de mí. Veía cómo me ponía la pistola en la
cabeza y me obligaba a..... yo no podía decirle que no a él. Yo
no puedo decirle que no a él. Veía cómo fue a la oficina y dijo
-tú eres un pequeño marica que no sabe mamar. Seguía viéndolo
cuando acabábamos de pasar en el automóvil por su casa rural y él
estaba allí de pie. Yo me sentía tan asustado. No podía decir que no.
Yo sentía una fuerza fuera de mi control. Me seguían viniendo las
imágenes una vez y otra vez y otra vez. Yo.... yo.... yo.... yo me
quedé en blanco. No sentía nada. No sabía matarlo. Lo corté en
la espalda. John lo sostuvo entonces y me dijo, deguéllalo y yo
mataré al próximo. Yo seguía sintiendo esta fuerza detrás de mí, como
una pared que me empujaba. Mi mente saltaba de una idea a otra y
yo no podría detenerlas. Es algo que viene y va. Yo pensaba que
esto era incorrecto, y entonces las imágenes regresaban. En las
imágenes FFFFFF me forzaba. Desde que abusó sexualmente de mí, yo
quería matar a FFFFFF. Pero yo no podía, no puedo. Le tengo
miedo. Puedo ver su cara, aun ahora si miro esa pared. Yo veo una
foto de él allí mismo en la pared. Yo sentía tanta rabia. Durante
un tiempo pensé que le estaba haciendo algo a ???. Yo no podía
detener el cuchillo, no podía, no podía.... A veces me despierto
y siento como si FFFFFF estuviera aquí. Tengo que asegurarme de
que no está. Yo sentía tanta rabia cuando le dí de puntapiés a GGGGGG y
entonces cuando yo estaba hiriendo con el cuchillo a mi primo.
Cada vez que yo recogía el cuchillo, veía las imágenes. No sabía
a quién estaba matando. No sabía quién yo era ni que el muchacho era
mi primo. Después de estar aquí durante una o dos semanas, vi a
FFFFFF en la televisión. Él estaba mirando a los reporteros de la
misma manera que me miró a mí cuando fui a su casa de campo. En
la televisión él tenía una mirada penetrante y estaba diciéndome -voy a
agarrarte. Yo sabía que él estaba diciendo eso con sus ojos».
Después del suceso, el paciente
continuó en un estado agitado, hipomaníaco, y psicótico, y con el
delirio de ser invencible y omnipotente. Durante su encarcelamiento, ha
continuado experimentando síntomas de trastorno de tensión
postraumática, caracterizado por escenas retrospectivas de los
episodios violentos, y de la cara y del pene del Sr. FFFFFF. Además,
también está experimentando pesadillas; se despierta frecuentemente
durante la noche; padece de ansiedad y agitación agudas , de
insomnio inicial, y de ideas de referencia de que el Sr. FFFFFF
puede «leer mis pensamientos y yo todavía puedo ver su cara y sentir su
presencia».
HISTORIA MÉDICA PASADA:
Por medio de CCCCCCCCC y de una
entrevista con sus padres, se obtuvo información con respecto a
la historia médica del paciente. Según estas fuentes, la historia
médica pasada y presente del paciente es poco notable. No hay
ninguna historia de enfermedades médicas mayores,
hospitalizaciones, lesión en la cabeza, pérdida del conocimiento,
ataques epilépticos o convulsiones o ambas cosas, o de trastornos
metabólicos. Tampoco hay ninguna historia de alcoholismo o de
ningún uso o abuso de sustancias ilegales.
HISTORIA PSIQUIÁTRICA PASADA:
Según las fuentes antedichas, no
hay ninguna historia de enfermedad psiquiátrica en la vida del
paciente o de ninguno de sus parientes. Tampoco hay ninguna historia de
trastorno de la conducta ni ninguna otra complicación anterior
con la justicia.
HISTORIA PSICOSOCIOLÓGICA:
A través de las entrevistas con
el paciente y con la familia de éste, de archivos académicos y
del estudio de documentos pertinentes al caso, se obtuvo información de
la historia del paciente.
La historia psicosociológica
revela que CCCCCCCCC AAAAAAA LLLLLL nació en Lagos, Nigeria en el
Hospital de Maternidad de Santiago. Su nacimiento y los hitos de
desarrollo estaban dentro de los límites normales, y hay ninguna
historia de problemas médicos, psicológicos o psiquiátricos
significativos a lo largo de su niñez y adolescencia. Se dio
parte de una fase moderada de ansiedad de la separación se
informó desde principios de pre-jardín de infantes hasta la edad
de siete años. El paciente cursó la enseñanza primaria y la secundaria
en la escuela Santiago para varones. Según informes recibidos,
tenía amigos y no tenía ninguna dificultad en el proceso de
adaptación al medio social. Sus notas, su aprovechamiento
académico y su conducta estaban dentro de los límites normales. El
estudio de sus calificaciones escolares desde 1992, y la revisión
de sus calificaciones universitarias mostró calificaciones de
nivel medio a superiores al nivel medio , y no se encontró ninguna
prueba de dificultades de la conducta ni de ninguna otra
perturbación de conducta que pudieran considerarse anormales o
problemáticas. Hay ninguna historia de trastornos de conducta o
violaciones significativas de normas durante sus años de desarrollo.
Parecía desarrollarse bien, y completó las tareas apropiadas
dentro de los límites de tiempo esperados. No hay historia de
abuso sexual o f'ísico o de ambos combinados en la niñez de este
muchacho. Desde el octavo grado, el paciente trabajó en varios
trabajos en correspondencia a su edad, como, por ejemplo, de
empaquetador en un supermercado, etc.,
Después de graduarse en la
escuela Santiago, el paciente asistió a la Universidad Estatal de
Lagos, y al momento de su arresto había terminado tres semestres de
Administración Comercial. El paciente está inscrito actualmente
en la Universidad Luterana de Niamey y ha terminado el sexto
curso por correspondencia durante el período de año y medio que
lleva encarcelado.
El paciente tiene una hermana de
18 años de edad , YYYYYY RRRRRR AAAAAAA ZZZZZZ que en la
actualidad asiste a clases en la Universidad de la Ciudad de Nueva
York, en Nueva York. Su hermana, a quien se cataloga como
estudiante excelente, ha recibido múltiples premios académicos.
CCCCCCCCC informó tener una relación excelente con ella. El padre
del paciente, AAAAAAA, es un hombre de negocios que ha logrado grandes
éxitos y alta estima en el campo de seguros en Nigeria. Su madre,
AAAAAAA, crió a CCCCCCCCC y a su hermana ZZZZZZZ hasta que ellos
cumplieron 12 y 10 años de edad, respectivamente. Luego fue a
trabajar con su marido que abrió entonces su propio negocio de seguros
. El matrimonio de los padres de CCCCCCCCC ha sido muy estable, y
la familia es muy conocida, respetada, y apreciada en la
comunidad.
La reacción y conducta
subsecuente de la familia de CCCCCCCCC han sido notables. Su
reacción inicial fue de susto profundo, escepticismo, y tristeza. No
sólo habían perdido a un sobrino querido a quien le tenían mucho
cariño y gran afecto, sino que, cuando se enteraron de que su
hijo había sido responsable, se quedaron devastados y destrozados.
Desde el arresto de CCCCCCCCC, su familia no lo ha abandonado.
Por el contrario, ésta ha participado intensamente en el proceso
de rehabilitación, de lo cual es prueba evidente que la familia lo ha
visitado cada día de visitas, que le ha suministrado 100 libros
que tratan temas sobre la salvación del alma y de la mente, que
ha dispuesto tratamiento psiquiátrico por parte de un psiquiatra
local que es muy respetado y bien conocido, el Dr. William
RRRRRRRRRRRRR, que ha coordinado visitas al paciente por parte
del Padre ??? a fines de consejería espiritual, así como visitas
múltiples por parte de parientes de CCCCCCCCC residentes en Niamey,
sobre todo, los tíos del muchacho - los doctores AAAAAAA y
PPPPPP - y, finalmente, que le ha ofrecido apoyo constante tanto
físico como emocional.
EXAMEN DEL ESTADO MENTAL:
El paciente fue examinado
inicialmente el 15 de mayo de 1986. Estaba alerta y orientado en
tres dimensiones. Aunque CCCCCCCCC negó signos psicóticos positivos,
exhibió un intenso grado de ansiedad, cautela y recelo. En el
encuentro inicial, a CCCCCCCCC le resultaba difícil sostener
contacto visual, y parecía estar apartado, distante, y agobiado por
procesos interiores, desconcertado, y sumamente aterrado al grado
de parecer desconectado del ambiente y de los demás. Su nivel de
desconfianza y sentido de amenaza inminente habían alcanzado
proporciones de paranoia y de alucinaciones. Además mostraba una
marcada constricción de sentimientos y retiro emocional.
El examen del paciente los días
17 y 18 de enero de 1988 reveló que CCCCCCCCC AAAAAAA LLLLLL es
un varón negro, nigeriano, de 20 años de edad, que aparenta su
edad cronológica. Fue entrevistado durante un total de 12 horas,
que incluyeron la administración de una batería completa de
pruebas psicológicas (las pruebas que se administraron y los
hallazgos de éstas aparecen más abajo). Se examinó al paciente en su
celda del Instituto Penitenciario de San Pablo en Niamey. Su
celda es bastante pequeña y era previamente un baño que se
convirtió en «cuarto para vivir» para garantizar un ambiente aislado y
restringido que le brinde seguridad al paciente. El paciente ha
estado recluido desde el 5 de mayo de 1986. En las paredes hay
numerosas fotos de la familia, hojas de papel con figuras
geométricas y ecuaciones matemáticas para prepararse para las
pruebas, un mapa del imperio romano, un recorte de periódico en
que se le rinden honores a su abuelo paterno después del
fallecimiento de éste, una copia del cuadro El Hijo Pródigo,
de Rembrandt, que le había dado a él su padre, y numerosos libros
de texto, incluso una Biblia, un diccionario, y varios libros
académicos relativos a su educación.
CCCCCCCCC tiene una estatura
aproximada de 5 pies 10 pulgadas (alrededor de 1,77m [nota del
traductor]) , y es de figura mediana, aunque él se equivocó al dar su
estatura con 2 a 3 pulgadas de menos (aproximadamente 50 a 76 mm
de menos [nota del traductor]). Estaba vestido con shorts
largos, una camiseta y zapatos de tenis. A lo largo de todo el examen
y durante las dos largas sesiones de evaluación su comportamiento
y conducta eran los de una persona desembarazada, agradable,
atenta y muy dispuesta a cooperar. Aunque a fines del primer día
el paciente estaba notoria y convenientemente cansado, permanecía
alerta, dispuesto a cooperar, y diligente en todas las tareas que
se le exigían. Hablaba intermitentemente, alto y presionado, lo
que revelaba un persistente estado de ansiedad . Los movimientos de las
manos y su inquietud ocasional también eran evidentes y
congruentes con su ansiedad. Su lenguaje era coherente,
espontáneo, y normal en producción y entrega, aunque en una ocasión,
al describir cómo el Sr. FFFFFF asesinaba al muchacho, el
paciente se puso notoriamente distante, desconcertado, e
incoherente, y se hizo muy difícil seguir sus verbalizaciones.
Este episodio duró varios minutos y fue seguido por un período de
acumulación de detalles en su proceso de pensamiento, lo cual
exigía redirección. Algunos minutos después, el paciente logró
reagrupar sus ideas y continuar con esa parte del examen. Cuando se le
hacía una pregunta, CCCCCCCCC se ponía pensativo y entonces
respondía con una actitud desembarazada y genuina. En ningún
momento les reprochó nada a los demás ni exteriorizó la
naturaleza de sus acciones. No obstante, el paciente describió su
estado mental como desconcertado, aturdido, y desconectado de sus
movimientos y acciones. Esto también se observó durante la
entrevista clínica.
Desde una perspectiva
cognoscitiva, el paciente estaba totalmente alerta y orientado en las
tres dimensiones. En el examen de Folstein sobre el estado
minimental, un procedimiento general para medir el funcionamiento
cognoscitivo, el paciente obtuvo una calificación de 29/30 -sólo
fue incapaz de recordar la fecha, lo que no es poco común entre
individuos hospitalizados y encarcelados. Sus funciones de
memoria inmediata, reciente y remota estaban intactas; el
paciente pudo seguir simples órdenes psicomotrices, y no hubo ninguna
señal de afasia, agnosia, apraxia, o anomia. Sus funciones del
lenguaje estaban intactas, excepto cuando estaba abrumado con
sentimientos de aflicción. Aunque el paciente pudo realizar
correctamente problemas simple de aritmética, su concentración en
esta tarea presentó dificultades entre ligeras y moderadas .
Parecía muy inseguro en sus respuestas y calculó y recalculó
verbalmente, de una manera bastante obsesiva, antes de ofrecer una
respuesta. Durante esta tarea el paciente declaró, -Esto me
produce mucha ansiedad. Me siento ansioso y ejerzo mucha presión
sobre mí mismo. Yo no confío en mi mente en estos cálculos-. Por
consiguiente, sus contestaciones, aunque exactas, fueron bien demoradas
e hizo pausas largas antes de responder. De manera general, y
sobre la base de la observación superficial, los procesos del
pensamiento parecían intactos, sin ninguna evidencia de trastorno
del pensamiento formal, es decir, asociaciones sueltas, paso
fugaz de ideas, bloqueo, o neologismos. Como ya se indicó, sin
embargo, se vislumbró una perturbación del proceso de
pensamiento, como lo demostraron la confusión, la incoherencia y la
acumulación de detalles. En la sección de Resultados de la Prueba se
aclarará la evidencia de la presencia de un proceso psicótico,
sobre la base de los hallazgos proyectivos de la prueba . El contenido
del pensamiento del paciente era mayormente flexible, ya que
podía pasar de un tema a otro. Sin embargo, sus pensamientos
parecían reflexivos y moderadamente alucinatorios cuando
describía la «presencia» del Sr. FFFFFF, y la capacidad que tenía éste
último de «saber lo que yo estoy pensando». La imagen
retrospectiva de «los ojos y cara perversos» tenía carácter
paranoico y alucinatorio, lo que probaba la presencia de ideas de
referencia. Aunque CCCCCCCCC había considerado intensamente el
suicidio luego de que hubieron abusado sexualmente de él, negó
tener ideación, intentos, o planes suicidas en este momento.
Después de una consideración cuidadosa de los eventos, todo
parecía indicar que el abuso sexual y la tendencia suicida
resultante contribuían a su ruptura psicótica y a sus pensamiento
alucinatorios. El paciente también niega tener pensamientos, deseos,
intento, o plan homicidas. En este momento no hay ninguna
evidencia de trastorno perceptivo en la forma de alucinaciones
auditivas, visuales, táctiles, olfativas, o gustativas. Su deterioro de
prueba de la realidad parece estar confinado al pensamiento
alucinatorio.
Los sentimientos de CCCCCCCCC
parecían estar constreñidos, con una escala limitada de expresión
afectiva. No obstante, eran adecuados al contenido y consistentes con
el tema a mano. Por ejemplo, al describir los incidentes más
difíciles, como por ejemplo, el abuso sexual, la muerte violenta
del muchacho, y particularmente el episodio homicida, la angustia
se hacía muy visible en su expresión facial; se ponía las manos
en su cara; descansaba los codos sobre las rodillas; miraba
fijamente el suelo; la cara y el cuello se le sonrojaban y se le
ponían de color rojo brillante; y decía repetidamente,
«Perdóname, Señor». Su humor indicaba una disforia general, con
fluctuaciones entre la ansiedad y la tristeza. Durante los momentos
de tristeza profunda, adoptaba una expresión facial de abandono y
su lenguaje era monótono y escasamente audible. Al hacerse un
examen íntegro de su discernimiento, se reveló que tenía capacidad de
distinguir el bien del mal, y que poseía un superego (conciencia)
fuerte, arcaico y punitivo que parecía ser implacable y estar
guiado por su voluntad propia. Parecía tener una idea adecuada
del carácter de sus acciones y de su perturbación psicológica actual.
Es decir, parecía entender el hecho de que requiere tratamiento
psiquiátrico debido al carácter de los traumas e incidentes que
han tenido lugar en su vida. No obstante, su capacidad de
distinguir la realidad de la fantasía parece estar menoscabada,
por momentos, por un pensamiento paranoico e imágenes
retrospectivas intrusas.

RESULTADOS DE LAS PRUEBAS:
Funcionamiento cognoscitivo e intelectual:
Como se indicó, el examen
cognoscitivo íntegro en el examen de Folstein sobre el estado
minimental rindió resultados que estaban dentro de los límites
normales. El coeficiente de inteligencia (siglas en inglés IQ) de
escala completa de CCCCCCCCC de 99 cae en un 47º percentil en
comparación con otras personas de su misma edad, y lo pone en una
clasificación media. Este coeficiente de inteligencia proporciona
una valoración de inteligencia general y de aptitud laboral y
académica de carácter general. Estos resultados, sin embargo, valúan
en menos del valor real su potencial intelectual real, y parecen
haber sido afectados por el nivel de ansiedad y secuelas
emocionales postraumáticas del paciente que interfirieron con su
capacidad de concentrarse y manipular información mentalmente. Este
declive cognoscitivo se obtiene al comparar su calificación
graduada de 14 (95º percentil) en la subprueba de vocabulario, la
medida exclusiva más sensible de funcionamiento premórbido en la prueba
de Wechsler sobre la inteligencia de adultos (revisada), con su
calificación media de 8,6 en atención-concentración, lo que es
una diferencia altamente significativa desde el punto de vista
estadístico y hace pensar en un deterioro cognoscitivo. Además, la
comparación del medio verbal con el factor de
atención-concentración (12,6 y 8,6, respectivamente) también
reveló una diferencia altamente significativa desde el punto de
vista estadístico entre las dos calificaciones, lo que hace
pensar en un deterioro de la concentración y un deterioro
cognoscitivo general secundarios al trauma.
CCCCCCCCC obtuvo un coeficiente
de inteligencia verbal de 103, que cae en el 58º percentil. Este
coeficiente de inteligencia brinda una indicación de habilidades
verbales, información, y capacidad de razonar con palabras del
paciente. Sin embargo, cuatro de las calificaciones de la
subprueba difirieron significativamente de su calificación verbal
media. Por consiguiente, el coeficiente de inteligencia verbal de
este paciente es un promedio de rendimiento inconsistente, y
quizás sea necesario interpretarlo así.
El coeficiente de inteligencia de
rendimiento del paciente de 95 cae en el 34º percentil. Este
coeficiente de inteligencia brinda una comprensión de la organización
perceptiva del paciente y de su capacidad de emplear imágenes
visuales en el pensamiento y de procesar material visual
eficazmente. Ninguna de las calificaciones que contribuyen al
coeficiente de inteligencia sobre rendimiento difirió
significativamente de la calificación de rendimiento promedio de
CCCCCCCCC. Por consiguiente, el coeficiente de inteligencia sobre
rendimiento parece ser un buen resumen de sus capacidades en este
área.
Las calificaciones relativamente
bajas en las subpruebas del intervalo de cifras y de aritmética
pueden asociarse con distractibilidad, atención o lapso de memoria
cortos, y concentración pobre en comparación con otros individuos
de la misma edad y capacidad de CCCCCCCCC. Estas subpruebas
también son muy sensibles a los estados emocionales y a los efectos
del trauma. Las calificaciones bajas en las similitudes y
realización del cuadro, con respecto a sus otras calificaciones,
pueden asociarse con una tendencia hacia patrones de pensamiento
concreto u otros modelos poco habituales de pensamiento, un hallazgo
que es consistente con los resultados en pruebas proyectivas, y
hace pensar en la posibilidad de un trastorno del pensamiento.
La calificación de comprensión
del paciente es significativamente más alta que su calificación
media de subprueba verbal. Esto sugiere una capacidad -relativamente
superior a la media- de enfocar situaciones prácticas o sociales
que requieren un razonamiento basado en el sentido común. Tales
calificaciones implican que la persona use sus conocimientos de manera
eficaz. Bajo tensión severa, sin embargo, puede ocurrir un menoscabo en
el discernimiento y en la capacidad de razonar, aunque el
paciente tiene capacidad de discernimiento y razonamiento
adecuados bajo condiciones normales.
La comparación de medios de las
subpruebas reveló una diferencia significativa a favor de las
habilidades verbales respecto a las capacidades cognoscitivas
perceptoanalíticas, lo que hace que este paciente sea
dependiente, desde el punto de vista cognoscitivo, de la esfera
de actividad . Este estilo cognoscitivo hace pensar en tendencias
de personalidad tales como la susceptibilidad a depender de otras
personas para la guía y dirección, y una tendencia a necesitar
estructura y apoyo externos. Debe notarse que la impulsividad y las
tendencias a expresar impulsos reprimidos en conductas sin
inhibiciones son inconsistentes con este estilo cognoscitivo.
Funcionamiento neuropsicológico:
Se administró una batería de
exámenes de evaluación neuropsicológica que rindió resultados
dentro del nivel normal. CCCCCCCCC obtuvo un índice de incapacidad del
1,30 el cual es más bajo que la calificación límite de 1,55
cuando se sospecha la presencia de deterioro orgánico. En la
prueba de investigación de afasia de la batería de pruebas de
investigación neuropsicológica de Halstead-Reitan , el paciente
no tuvo ningún error ni hubo ninguna evidencia de apraxia de la
construcción, anomia, apraxia de la ortografía, agrafia, agnosia
y alexia de letras y números, disartria central, agnosia verbal
auditiva, acalculia, apraxia ideocinética, desorientación de
derecha a izquierda, agnosia corporal, ni de supresión visual,
auditiva y táctil por sí misma ni combinada con lo anterior.
En Trails A, sin embargo, el
paciente desplegó un ligero deterioro visuomotor que parecía ser
una función de ansiedad ya que ésta fue la primera prueba cronometrada
de la batería, y su rendimiento en el símbolo del dígito y en
Trails B estuvo dentro de los límites normales. Su rendimiento en
Trails B, el instrumento individual más sensible que existe para
la identificación de deterioro orgánico, estuvo dentro de los
límites normales. Es decir, el paciente pudo cambiar de juegos
cognoscitivos adecuadamente y seguir una sucesión mental más
compleja. En resumen, estos resultados son consistentes con la ausencia
de deterioro orgánico y no brindan ninguna evidencia de
disfunción o compromiso neuropsicológicos.
Funcionamiento emocional y de personalidad:
Los resultados de pruebas
objetivas y proyectivas revelan la presencia de una
psicopatología que es consistente con aquellos individuos que han
experimentado un trauma psicológico severo, a saber, una
perturbación afectiva severa y un estado depresivo, un menoscabo de
la prueba de la realidad, funciones y debilidad limitadas y
traumatizadas del ego, una autovaloración y autoestima
empobrecidas y remanentes fóbicos de abuso sistemático.
Resultados del inventario de
personalidad multifásico de Minnesota - 2.
Este inventario produjo hallazgos
válidos sobre la base de las elevaciones de las escalas de
validez. Es decir, este paciente contestó de una manera veraz, y no
hubo evidencia de una psicopatología de información por exceso o
por defecto. Hubo elevaciones en dos de las escalas clínicas
correspondientes a la admisión de actos antisociales, desconfíanza
de individuos en puestos de autoridad, y rasgos paranoicos. La
elevación en la escala clínica paranoica es consistente con la
manifestación de conducta psicótica, con la presencia de un
trastorno del pensamiento, de ideas de referencia, y de delirios de
persecución. CCCCCCCCC también obtuvo una calificación muy baja
en la escala de manía, lo que hace pensar en depresión, letargo,
indiferencia y apatía general. Además, el paciente obtuvo una
calificación anormalmente baja en la escala suplementaria de
fortaleza del ego, lo cual es consistente con recursos personales
limitados para hacer frente a problemas y situaciones que
producen tensión, y con autoestima baja. Hay también evidencia de
que el paciente se siente abrumado con sentimientos y de que
tiene dificultad en procesar y expresar sentimientos de una
manera exterior. Hay también presencia de cólera y agresión, lo
cual no es un hallazgo poco común entre aquellas personas que han
sido víctimas de abuso, manipulación y explotación. Debe notarse
que la reseña de CCCCCCCCC es inconsistente con las reseñas típicas de
trastornos de personalidad antisocial, y con individuos que han
sido encarcelados por homicidio premeditado, o mala conducta y delitos
sexuales.
Se le administró a CCCCCCCCC la
escala de trastornos de tensión postraumática administrada por un
clínico para DSM IV (CAPS-Dx). El CAPS-Dx es una entrevista
estructurada con propiedades psicométricas demostradas, es decir,
confiabilidad y validez, y ha logrado una utilidad de diagnóstico
excelente.
Los resultados del CAPS-Dx
revelaron que después de la agresión sexual que sufrió en marzo
de 1986, CCCCCCCCC presentó síntomas que satisficieron el criterio de
diagnóstico de trastorno de tensión postraumática, crónico. Estos
síntomas incluyeron: pensamientos intrusos y altamente
aflictivos, imágenes y recuerdos del evento; episodios de escenas
retrospectivas o de volver a vivir la experiencia; intensos
sentimientos de inquietud, náusea, vulnerabilidad, ansiedad,
terror e ira en respuesta a los recuerdos del evento; evitación
persistente de estímulos (personas, lugares, actividades,
pensamientos, y sentimientos) asociados con el evento; separación
o alejamiento respecto a otras personas (sobre todo, respecto a su
familia); y síntomas de hiperexcitación, incluso pensamientos
galopantes, dificultad para dormir, irritabilidad, volatilidad,
sensibilidad al ruido, y dificultad de concentración. Finalmente
CCCCCCCCC experimentó una aflicción clínicamente significativa y
deterioro de su funcionamiento .
En el inventario de ansiedad de
Beck, el paciente admite tener síntomas moderados de ansiedad
psicológica, pero niega todas las manifestaciones fisiológicas, lo cual
es inconsistente con las observaciones clínicas y síntomas que
está experimentando actualmente, a saber, escenas retrospectivas,
insomnio, pesadillas, y trastornos perceptivos. De manera semejante,
el paciente obtuvo una calificación de depresión en el nivel
ligero de trastornos depresivos y no endosó artículos en el
MMPI-2 que tenían que ver con la depresión. Esto, sin embargo, es
consistente con el hecho de que el paciente parece estar desconectado
de su estado afectivo y es incapaz de reconocer su perturbación
afectiva actual, particularmente debido al hecho de que hay
numerosos hallazgos de una depresión severa en las pruebas proyectivas,
y también debido al hecho de que el MMPI-2 hace pensar en un
trastorno distímico como uno de los posibles diagnósticos basados
en los resultados.
Se obtuvieron interpretaciones
clínicas del psicodiagnóstico de Rorschach mediante la
utilización del sistema de Exner y sobre la base del análisis
estadístico de este protocolo. Los hallazgos en el
psicodiagnóstico de Rorschach revelan la presencia de un trastorno
afectivo mayor y de un compromiso de prueba de la realidad que se
manifiesta mediante distorsiones de la realidad y el potencial
para una ruptura psicótica. El hallazgo más significativo en esta
parte del examen es el hecho de que CCCCCCCCC obtuvo un F+% de 32
lo que es muy significativo respecto al potencial de perder
contacto con la realidad y de volverse psicótico, particularmente
bajo tensión severa o cuando está cargado de sentimientos. Es decir, su
calificación es significativamente más baja que el F+ % de 70 o
más alto que se esperaba para que las percepciones caigan en el
nivel normal, a fin de que el paciente tennga la capacidad de
funcionar dentro de la realidad y no tienda a ponerse alucinatorio y
psicótico.
Este protocolo también es
consistente con individuos que han sido víctimas de abuso severo
debido a la evidencia inequívoca de una autoestima muy baja;
sentimientos graves de modulación de dificultades; emociones que
dominan la habilidad de pensar, de procesar, y de razonar de
manera normal; la tendencia a evitar estímulos emocionales y, como
resultado de esto, a reprimirse socialmente o aislarse; la
tendencia a ser más negativista u opositor respecto al medio que
la mayoría de las personas; confusión sobre sentimientos
simultáneamente positivos y negativos con respecto a la misma
situación de estímulo; separación y intelectualización, y una
tendencia a tergiversar la realidad; un estado psicológico
claramente hipervigilante y paranoico que resulta de desconfíanza
del medio y sentimientos de vulnerabilidad; pasividad y tendencia
a rendirse a otros; tendencia a percibir la agresividad como una
manifestación natural en las relaciones interpersonales; problemas en
el procesamiento de información; escape a la fantasía y rechazo
de la realidad; impotencia y vulnerabilidad a las manipulaciones
de otros; vulnerabilidad a la desorganización durante
experiencias emocionales intensas ; y problemas serios del pensamiento
y de conceptualización deficiente que interfieren con la lógica y
promueven un juicio deficiente.
El análisis de contenido revela
la presencia de residuos de trauma psicológico, por ejemplo, «Una
cara malvada de alguien malvado. Tiene una expresión diabólica,
enfadado, con una sonrisa burlesca». Además hay numerosas
respuestas que corresponden a la tristeza y a la disforia
general, tal como se evidencia por el contenido, tonalidad, y formas y
colores amorfos. Estos hallazgos fueron consistentes con sus respuestas
en la prueba de apercepción temática, en la que sus historias
tienen un final trágico y hay presencia de una conciencia fuerte,
punitiva que parece ser de naturaleza tenaz. Sus dibujos también
son consistentes con una autoestima empobrecida y con los
sentimientos de debilidad, estado indefenso y vulnerabilidad al
ambiente y al mundo.
FORMULACIÓN:
CCCCCCCCC AAAAAAA es un muchacho
de 20 años de edad que estuvo involucrado en el secuestro y
homicidio de su primo de 12 años de edad luego de una serie de eventos
altamente traumáticos en los que CCCCCCCCC estuvo repetidamente
expuesto, de manera sistemática y malévola, a traumas
psicológicos agudos y horrendos. Su retrato psicológico general es el
de un individuo intelectualmente brillante y que tiene el
potencial para un alto funciomiento intelectual. Sin embargo,
aunque el paciente clasificó en un nivel de inteligencia medio,
mostró un deterioro cognoscitivo y no funcionó al nivel de su capacidad
intelectual verdadera. Aunque no hay ningún hallazgo orgánico
positivo en su protocolo, el paciente mostró dificultades
respecto a la atención y a la concentración, y con respecto a su
capacidad de procesar información, particularmente cuando está
bajo tensión. Su estilo cognoscitivo es consistente con la
dependencia de la esfera de actividad; esto hace pensar en una
vulnerabilidad a ser manipulado por parte de otros, una dependencia
psicológica en otros para la afirmación, y una necesidad de
estructura. Hay amplia evidencia, a través de pruebas, del
potencial de psicosis y de prueba deteriorada de la realidad, así como
una perturbación afectiva mayor en forma de depresión subyacente
y subclínica. Hay también evidencia de los efectos de trauma
psicológico -de haber sufrido abusos psicológicos y físicos, y de haber
quedado desamparado y sometido al control de otra persona
poderosa a la cual el paciente era incapaz de contradecir y de
quien era incapaz de escapar. En este caso, CCCCCCCCC alcanzó un
punto en el que sus defensas psicológicas normales estaban rotas, y
estaba funcionando de una manera robótica y totalmente
desconectada.
Este caso se conceptuó y se
explicó la conducta del paciente desde la perspectiva de un
desorden psicótico, un trastorno de tensión postraumática, y la
influencia controladora de otra persona poderosa de quien
CCCCCCCCC creyó que no podríaescapar. Estos tres problemas
se tratarán separadamente.
Según el Diccionario
Enciclopédico Médico de Taber, la psicosis se define como «término que
anteriormente se usaba para denominar cualquier trastorno mental, pero
que ahora generalmente está restringido a aquellas perturbaciones
de tal magnitud en que hay desintegración de la personalidad y
pérdida de contacto con realidad. Las perturbaciones son de
origen psicogénico, o sin causa física claramente definida o cambio
estructural en el cerebro. Estas perturbaciones se caracterizan,
normalmente, por delirios y alucinaciones... Este estado se
manifiesta en la conducta, reacción emocional, e ideación del paciente.
El paciente no refleja la realidad tal como es, reacciona
erróneamente a ésta, y construye falsos conceptos con respecto a
ésta. Las respuestas de conducta son peculiares, anormales,
ineficaces, o definitivamente antisociales. Todo esto no incluye
amencia porque la inteligencia deficiente meramente disminuye la
comprensión de la realidad pero no la distorsiona...» El
Diccionario Médico de Steadman agrega: «Un desorden mental que causa
una distorsión íntegra de la capacidad mental de una persona, de
su respuesta afectiva, y de su capacidad de reconocer la
realidad, de comunicarse, y de relacionarse con los demás al grado de
las demandas de la vida cotidiana...» Según el Manual Diagnóstico
y Estadístico de Trastornos Mentales (siglas en inglés DSM IV),
el término psicótico corresponde a síntomas reales
tales como delirios, y alucinaciones prominentes, lenguaje
desorganizado, o conducta desorganizada o catatónica. En este
caso, el síntoma psicótico más prominente es el de delirio, que
en DSM IV se define como «creencias erróneas que normalmente incluyen
un mala interpretación de percepciones o experiencias». A fin de
satisfacer los criterios de trastorno psicótico breve, el manual
DSM IV incluye el delirio como uno de los síntomas que deben
estar presentes para recibir este diagnóstico. Además, en DSM IV se
declara que «los individuos con trastorno psicótico breve
experimentan típicamente un disturbio emocional o una confusión
abrumadora. Dichos individuos pueden variar rápidamente de uno
sentimiento intenso a otro. Aunque breve, el nivel de deterioro
puede ser un discernimiento excesivamente pobre,... deterioro
cognoscitivo, o actuación basada en delirios... La duración de un
episodio de la perturbación es por lo menos un día pero menos de
un mes, pero finalmente se produce un regreso pleno al nivel de
funcionmiento premórbido... .Con el estímulo marcado que causa
tensión [Marked Stressor]... .se puede notar si los síntomas
psicóticos se desarrollan inmediatamente después y obviamente
como respuesta a uno o más eventos que, individualmente o juntos,
causarían una tensión notable a casi cualquier persona que se
hallara en circunstancias similares en la cultura de esa
persona». En otras palabras, una psicosis lleva consigo la
incapacidad de funcionar dentro de los límites y constreñimientos de la
realidad en un momento dado.
En el caso de CCCCCCCCC, hay
evidencia de cambios rápidos en sentimientos, conducta
desorganizada, y acciones basadas en la percepción de una «fuerza» que
estaba empujándolo «por detrás». Numerosas personas lo vieron
irse de la casa con su primo, y todavía pensaron que nada malo
ocurriría. También es importante destacar que, según se informó, el
estado de mente del paciente respecto a las imágenes y
pensamientos que se presentaban de manera restrospectiva en su
conciencia da mayor evidencia de un estado psicótico. Debido a que
el paciente usó tal discernimiento deficiente y que él no es
intelectualmente deficiente, el aspecto psicótico de su
enfermedad parecía ser el estado mental primario de este paciente
anterior al momento del homicidio y durante ese momento. Además,
en la prueba de Rorschach hay una evidencia clara del potencial
de distorsión de la realidad y de psicosis en cuanto a que el
nivel de la forma era significativamente inferior de lo que se
espera de un funcionamiento normal. En MMPI-2 también hay
evidencia de pensamiento paranoico. Este hecho, unido a un
deterioro de prueba de la realidad lleva a la conclusión de un proceso
psicótico.
Según DSM IV, las características
del diagnóstico de un trastorno de tensión postraumática
correspondientes al caso de CCCCCCCCC son «el desarrollo de síntomas
característicos posteriores a la exposición a un estímulo
traumático extremo que causa tensión y que concierne a una
experiencia personal directa de un evento que incluye la muerte real o
amenaza de muerte, o una lesión grave; o una amenaza a la
integridad física propia; haber sido testigo de un evento que
incluye la muerte real o amenaza de muerte, o una lesión grave; o
amenaza a la integridad física de otra persona...» Entre los
síntomas que se esbozan en DSM IV, CCCCCCCCC satisfizo los
criterios siguientes: La respuesta de la persona incluía miedo
intenso, desamparo, u horror; recuerdos recurrentes e intrusos del
evento, incluso imágenes, pensamientos, o percepciones; sueños
recurrentes del evento; actuar o sentir como si el evento
traumático estuviera repitiéndose; una intensa aflicción psicológica al
quedar expuesto a señales interiores o exteriores que simbolizan
un aspecto del evento traumático o se asemejan a éste;
reactividad fisiológica al quedar expuesto a señales interiores o
exteriores que simbolizan un aspecto del evento traumático o se
asemejan a éste; esfuerzos por evitar los pensamientos,
sentimientos, o conversaciones asociados con el trauma; sentimientos de
separación o alejamiento de los demás; nivel restringido de
sentimientos; dificultad en dormirse o quedarse dormido;
irritabilidad o arranques de enojo; dificultad de concentración; e
hipervigilancia.
Según la literatura científica
respecto a los efectos y secuelas psicológicos del trauma, en el
transcurso del trauma una fuerza abrumadora deja a la víctima
desamparada. En este caso, CCCCCCCCC había experimentado en el
transcurso de una semana el hecho de presenciar la muerte a
sangre fría de un muchacho luego de una provocación muy pequeña; había
sido víctima de violación sexual y había sido obligado a realizar
felación. El trauma confunde las adaptaciones humanas ordinarias
a la vida. Las tres reacciones más comúnes al trauma son:
hiperexcitación, en la cual se halla presente un estado permanente de
excitación fisiológica y que es el primer síntoma cardinal de
tensión postraumática; intrusión, o volver a vivir el evento como
si se repitiera en el momento presente; y la constricción, en la que la
persona se siente completamente impotente y puede entrar en un
estado de rendición al cerrarse el sistema de autodefensa cierra
y quedar la persona paralizada psicológicamente.
La manera de establecer control
sobre otro ser humano consiste en inflingirle, de manera
sistemática y repetitiva, un trauma psicológico, con lo cual se le
produce un estado constante de miedo y terror, arranques de
violencia inconsistentes e imprevisibles, el uso intermitente de
premios, la destrucción de ataduras normales y el aislamiento de la
persona respecto a su familia, la destrucción del sentido de
autonomía de la víctima, el uso de la humillación y de la
vergüenza mediante violación del cuerpo físico de la persona y, lo que
es más importante, la más destructiva de todas las técnicas
coercitivas: ser obligado a violar los propios principios morales
de la persona y a traicionar sus ataduras humanas básicas.
La mirada inicial de ojos
hundidos de CCCCCCCCC, su separación de su familia y de sus seres
queridos, la presentación inicial disociativa, poco profunda y
psicótica, la sensación de que el perpetrador todavía está
presente, las señales y síntomas clínicos que se han mencionado
encima, así como la evidencia científica de los resultados de estas
pruebas, apuntan al hecho de que este muchacho, de hecho, estaba
bajo el control psicológico del Sr. FFFFFF, y estaba
experimentando una situación de la que él pensaba que no había ninguna
escapatoria. Por consiguiente este cuadro clínico es consistente
con un breve trastorno psicótico, un trastorno de tensión
postraumática, y una depresión subclínica. No se dará ningún
diagnóstico en Axis II debido al hecho de que el paciente no
satisface los criterios de diagnóstico para ninguno de los
trastornos de Axis II; no hay ninguna historia de trastorno de conducta
ni ningún otro índice de otras violaciones mayores en la historia
de este muchacho. Este equipo de evaluación llega a la conclusión
y acuerdo general de que CCCCCCCCC AAAAAAA LLLLLL parecía estar
psicótico en el momento del homicidio y creyó que estaba matando al Sr.
FFFFFF durante el acto homicida.
Con respecto a la prognosis y a
la rehabilitación, es el acuerdo general de este equipo que hay
una prognosis favorable por las razones siguientes:
- BBBBB Vvvvvvv es brillante y tiene capacidad intelectual
para entender las consecuencias de sus actos y se beneficiaría de
una psicoterapia intensa.
- Hay evidencia de remordimiento y de un deseo y motivación
de rehabilitación.
- Este equipo entiende que BBBBB Vvvvvvv no ha tenido
dificultades de conducta durante el año y medio en que ha estado
encarcelado.
- El paciente tiene un fuerte sistema de apoyo en su familia
y en los esfuerzos rehabilitadores que ésta realiza.
- En la actualidad, el paciente puede contener sus emociones
y no ha perdido el control durante su encarcelamiento.
- El paciente tiene capacidad de discernimiento.
- El paciente ha logrado un mayor acceso a sus sentimientos
durante su encarcelamiento.
- El paciente ha mostrado beneficios de su tratamiento con el
Dr. RRRRRRRRRRRRR.
- El paciente se ha encontrado, de manera regular, con un
sacerdote, y se ha beneficiado de aquellos encuentros.
- No hay ningún diagnóstico de Axis II que contraindique la
capacidad del paciente de beneficiarse del tratamiento.

RECOMENDACIONES:
Este equipo recomienda, por
acuerdo general, que BBBBB Vvvvvvv continúe con los esfuerzos
actuales de rehabilitación por parte de su familia, de su psiquiatra, y
de su consejero espiritual. Es obvio que el paciente se ha
beneficiado de estas intervenciones de una manera notable. Es
evidente, también, que el paciente continúa requiriendo esta guía,
ayuda, y tratamiento para continuar con su rehabilitación.
